Finally, a Politician that understands Internet Privacy, Rep. Carl Zimmerman, D-Palm Harbor has introduced Florida HB 677, a Mugshot Removal Bill. With an Effective Date of October 1, 2013, the bill requires that operators of Mugshot Websites remove a person’s name & information within a specified period after notice that person is acquitted or charges are dropped or otherwise resolved without conviction. It provides for a civil penalty against Mugshot Websites in Florida and provides for presumption of defamation against Mugshot Website Owners.

Here is a list of some of the Mugshot Websites in Florida and their current removal policies.

  • Mugshots.com – This Mugshot website has been collecting and cultivating mugshot photos and arrest records for websites for many years. The owner of this website is rumored to be in Florida but their true identity is unknown to the Internet Privacy Community. They charge $399 for one mugshot, $798 for 2, $1,197 for 3 and $1,479 for 4. Even if the charges were dropped or not adjudicated, they charge these fees. They use to provide Removal Services, but in 2012, a new site www.unpublisharrest.com was launched. In some cases, the removal service company (a reseller of mugshots.com) asks for you to email or fax them the court records. After reviewing the court records emailed, they may elect not to remove the mugshot. This company use to provide a free service for lawyers for removal of cases that were expunged or dropped, but that service was terminated in 2012. Mugshots.com provides a link to Facebook.com for facebook users to comment on any mugshot photo/arrest record. The company’s domain is registered in Belize City, Belize. Mugshots.com’s IP Address 184.72.221.63 appears to be hosted by Amazon.com (216.182.224.79).
  • Florida.Arrests.org or Arrests.org – This company is owned by ex-con and entrepreneur Robert Wiggin of New Orleans, LA / Winter Park, Florida. There is no removal information on the website. The only contact information is the email address info@arrests.org. There are removal websites that allegedly remove the mugshots for $399. There is section for comments under each mugshot. The Domain is registered to a Carlos Diaz in the city of Panama, Panama. Their website appears to be hosted in Sweden (IP 178.16.212.2). Their email address is info@arrests.org.
  • Jailbase.com – This company publishes Florida Mugshots on its website. There is a subscription service for users for $29.95 per month with detailed arrest information. They appear to resell mugshot data. They remove the information after 90 days. They have a contact form to remove inaccurate information only, not arrest information that was expunged, or the charges dropped. The company is located at 303 E. Gurley Street, #478 in in Prescott, Arizona. Their Email address: jailbase.support@gmail.com.

We’ve seen some of the cries on the Internet by the Mugshot Removal Company owners from their probable Multi-Million Dollar Homes with multiple sports cars in driveway. We’ve hard about their claim about their First Amendment Rights and their excessive costs to unpublish records from their database. The fact of the matter is that to remove a record from a database is simply minutes, deleting a database entry and a photo. The more costly expense is scanning the photos and photo copying the arrest records from the thousands of county courts offices throughout the United States. Since many of these companies are going back 10 or more years to put this information on the Internet, that’s where the money is being spent.

The real problem we’ve seen is that these mugshot websites are engaging in “reputation blackmail” and “extortion”. They are hiding behind the lack of Internet Privacy Laws. These sites don’t have to publish their Company Address and Location so if you are going to litigate against them, you’ll have to find them. In addition, the Search Engines like Google, Microsoft Bing and Microsoft Yahoo index their content. Facebook allows them to link their content. Hosting Services like Amazon host their services. Some of these companies even have their servers located in other countries to shield themselves from litigation.

1. Login to your YouTube.com Account.

3. Select the Videos you want to Remove from your YouTube Watch History then click [Remove] or click [Clear all watch history]. Click [Pause watch history] to disable the collection of this information by YouTube.com and secure your Internet privacy.

If you get the above screen, do not click Cancel. If you do, it will still act like a virus and post the original SchoolFeed post on your Wall to your Facebook Profile Page.

SchoolFeed, was purchased in 2012 by the owner of Classmates.com. You do not need this application, if you want to see your friends on Classmates.com, go directly to that site. There is no advantage to using SchoolFeed, it is predatory and begins posting your photo on your Friends, their Friends walls. That is horrible unless you want your photo as the poster person for SchoolFeed.

We tried a number of different methods, but the recommended solution is to use the Block apps Facebook feature. After that, you should delete any posting on your Wall or Profile Page. Here are the steps:

1. Go to your Facebook Privacy Settings Page – Use the Down Arrow in the upper right top of your Facebook Profile Page and click Privacy Settings.

2. Under Privacy Settings, click Mange Blocking under Blocked People and Apps.

3. Under Block apps, add schoolFeed to your list of Block apps.

We changed our listing at no-charge. It is similar to the process at Google Local and Bing Local. You can verify your business listing by email, phone or post card. The Yahoo Small Business Center has a URL that uses this interface.

This process took about 30 days to change. There is a contact form to customer support if you want to remove a listing.

In October 2012, we noticed that there is no longer a link to the Infogroup.com / Expressupdateusa.com website on the WhitePages.com website. Their only alternative is Yext.com at the $149 to $499 per year fee.

This time it is RiVoters.com that contains Rhode Island voters’ names, dates of birth, phone numbers and addresses. Tom Alciere of Nashua, N.H. was forced to resign in 2001 from his seat in the New Hampshire House of Representatives after it was discovered that he’d expressed support for killing policeman.

Tom Alciere owns several other similar public record data websites: SortedByName.com, MarriagesInTexas.com. These sites including www.RiVoters.com generate revenue from advertising (Google Advertising and PeopleSmart).

What is unique about Tom Alciere’s suite of websites is that his privacy policies (rivoters.com/privacy.html) are some of the most invasive on the Internet. As a Data Broker collecting more than 5,000 names under President Obama’s Consumer Privacy Bill of Rights (February 2012) and the FTC’s Privacy Report (March 2012), he provides “NO REMOVAL POLICY” for this data. In fact Tom Alciere is one of the few website owners that has engaged in republishing emails received from those emailing him requesting personal information record removal — or wanting to express their views on his unwillingness to remove their personal data. The RiVoters.com website has Private Domain Registration Contact Information that is registered and hosted by a company in the United Kingdom, LiquidNet Ltd. / Lonex.com. For RiVoters.com, an email contact is not listed but the RiVotes.com registrant email is  support@propersupport.com +1 773-305-5641.

The RiVoters.com contains a database file that has been republished by the site owner with the entire Rhode Island Voter Registered Voter List. This Internet practice is used by many Hacker or Hacktivist groups.

How to Remove Yourself from CheaterVille

If any an ex-boyfriend, ex-girlfriend, ex-husband, ex-wife posted a message on James McGibney’s CheaterVille site (see photo), it’s virtually impossible to remove unless you know the identity of the  poster. The problem with the CheaterVille site is that is allows the poster to be virtually anonymous.

In fact if CheaterVille were served with a subpoena for the IP Address, it’s most likely that CheaterVille wouldn’t have one that correlates to an individual.

In other words, CheaterVille has “No Removal Policy”.  As a user you can only report posts for:

  • Inappropriate Language
  • Suggestive Violence
  • Contains Personal Info
  • Inappropriate Image

CheaterVille Posting Policy says: “Because you are legally responsible for your postings, you may be subject to liability if your posts are found to be defamatory, harassing, or in violation of any applicable law. You may also be liable if you make postings which include any material or information (e.g., music, videos, text) that belongs to a third party and is used without permission or authorization.” So unless you can prove the poster posted Personal Info (your birth date is excluded) or a DMCA Copyright Violation over your Personal Photo, it’s likely CheaterVille will ignore your removal request.

Furthermore, CheaterVille’s Code of Ethics include: You agree to respect the privacy of others and refrain from discussing sensitive topics. You will not post any material that is:

  • unlawful
  • inaccurate
  • harmful
  • tortious
  • abusive
  • obscene
  • pornographic
  • defamatory
  • libelous
  • harassing
  • invasive of another’s privacy
  • offensive
  • vulgar
  • threatening
  • malicious
  • hateful or racially, ethnically or otherwise objectionable or violates any law.

Unfortunately, the other problem with CheaterVille is that almost every post is similar to the guests of the Jerry Springer Show. It includes multiple violations or alleged violations of their proclaimed CheaterVille Code of Ethics.

There are Reputation Management Companies ($399) that will purport to push the information down in the Search Engine Listings. This may or may not be helpful to your situation. There are also Arbitration Companies ($199) that will attempt to mediate a removal through Arbitration. Unfortunately, may not work and the anonymous poster will have the opportunity to add other public information about you.

CheaterVille Public Postings are not like the Dating Sites, they are public so Google and other Search Engines regularly index their data. So if you have an uncommon last name, chances are this listing will appear on the page one search results.

Are you one of the 2 Million Banjo (www.banj.jo) users that is using the Banjo Mobile Application? This Social Discovery App works like many of the Dating sites and LinkedIn.com and sends a mobile notification to the user when you view their profile. Here are some tips for anonymous viewing on Banjo.

  • Banjo Users – Although you see Twitter, Foursquare, LinkedIn and Facebook users, only registered Banjo users are notified. Before you view a users’s profile, check if they have a B icon on the right bottom corner of their profile (see below).

  •  Non-Banjo Users – If you view these user’s profiles, they will not be notified. You can view these Anonymously.
  • Map / Feed / People – If you are unsure, click on the People tab at the bottom of the screen (the above graphic on the Banjo site is old). It may be easier to see the Banjo icon using the People view.
  • Anonymous Viewing — This feature does not exist yet for viewing Banjo Users Profiles. If you view a profile with the Banjo icon on it, they will receive an immediate notification.

Banjo is one of the new very cool and emerging Social Discovery Apps. The “Someone Just Viewed Your Profile” feature is not new, LinkedIn and some of the Dating sites (eHarmony) use it. We emailed Banjo if they had an Anonymous Viewing option planned for in the future. They did not respond to our email.

Finally, there is no current known Facebook App that detects “How to See Who Views Your Facebook Profile”. Facebook must approve all Facebook Apps and will not approve any with this feature. If you receive an invitation to download such an App, it’s likely virus or malware.

What is intrusive about this feed is that the top videos are from Socialcam or Viddy, and to watch these trending videos you once again must install these Social Media Apps. In addition, the Facebook Privacy settings do not provide a privacy setting to enable or disable Facebook Trending Videos. Here are recommended steps to block Socialcam and Viddy from posting on your Wall.

If you haven’t noticed these videos on your Facebook News Feed, here is an example:
